ORANJESTAD — After several postponements and complications involving legal representation, the substantive hearing in the criminal case against Chania Fernandes Pedra is finally scheduled to begin today, Wednesday, November 4, at 1:30 PM. Fernandes Pedra is accused in connection with the fatal traffic accident of January 4, 2026, which claimed two lives on L.G. Smith Boulevard, near Renaissance Mall.
The case, one of Aruba's most closely followed criminal proceedings this year, returns to court with one important question still unanswered: Has Fernandes Pedra managed to secure an attorney to represent her during the trial?
During the previous hearing on October 2, the case could not proceed to substantive consideration because the defendant rejected the assistance of a criminal defense attorney from Curaçao appointed by the court. The judge indicated that the proceedings could not be postponed indefinitely and set November 4 as the new hearing date.
TWO LIVES LOST IN FATAL ACCIDENT
The case stems from the January 4 tragedy, when a Jeep Compass struck two pedestrians crossing the road near Renaissance. The victims, Josely Paulina Vasquez Gonzalez (65) and Carlos David Vialez Valerio (54), both of Dominican origin, lost their lives. According to the Public Prosecutor's Office, Fernandes Pedra faces charges including the murder of two people, the attempted murder of two others, driving under the influence of alcohol, driving without a valid driver's license and leaving the scene of an accident. The prosecution alleges that the defendant was driving at excessive speed and failed to take sufficient precautions to avoid the collision. These allegations remain subject to examination and proof during the judicial proceedings.
LEGAL REPRESENTATION ISSUES DELAYED THE CASE
During previous hearings, the lack of effective legal representation became a significant obstacle. Several attempts to arrange legal assistance failed to produce a lasting solution.
At the last hearing, the judge rejected a request to suspend Fernandes Pedra's pretrial detention, meaning she remained in custody. The judge also emphasized the importance of adequate legal representation for the proceedings to continue.
As of now, there is no confirmation that Fernandes Pedra has finally secured an attorney to assist her at today's hearing.
STRONG PUBLIC INTEREST IN THE PROCEEDINGS
The fatal accident and subsequent court developments have generated considerable public interest in Aruba. Beyond the seriousness of the charges, the repeated delays and questions surrounding the defendant's right to legal representation have kept the case in the public spotlight.
This afternoon's hearing is expected to clarify whether the court can finally begin examining the charges or whether another obstacle will arise.
The hearing is scheduled for 1:30 PM. Fernandes Pedra retains the presumption of innocence unless and until a final court judgment establishes her guilt.
