ORANJESTAD — According to a document presented as a ruling by Aruba's Court of First Instance, a UTV tour operator and its insurer must pay two injured tourists an advance of USD 15,000 in compensation following a serious off-road accident.
The vehicle overturned after leaving the designated route. An investigation found defects in its braking and steering systems that had not been adequately checked before the excursion.
The judge rejected claims that the tourists were responsible and ruled that the signed liability waiver could not shield the operator from responsibility under these circumstances.
The operator and insurer must also compensate additional damages to be determined later and cover legal costs. The document does not specify the ruling date. Read the verdict HERE.
