ORANJESTAD — Ex minister Otmar Oduber’s legal team supports his decision to pursue a cassation appeal before the Supreme Court of the Netherlands. According to the defense, the Court of Appeal’s judgment contains substantial flaws in its assessment of the evidence and reasoning for the conviction.
The main objections are that the court did not sufficiently address the defense’s arguments, relied on evidence contradicted by other material in the case file, and inadequately explained its decision to convict.
The defense also maintains that the court gave excessive weight to the Landsrecherche investigation file without sufficiently considering testimony from more than 25 witnesses. According to the legal team, several witnesses clarified their statements before the examining magistrate, identifying discrepancies or misinterpretations in the initial interviews.
In cassation proceedings, the Supreme Court does not retry the facts but reviews the application of the law and the judgment’s reasoning. If the judgment is overturned, the case may be referred back to the Court of Appeal for a new hearing. These criticisms represent the defense’s position.
