Prosecutors impose fines of up to Afl. 15,000 for human smuggling and illegal employment

ORANJESTAD — Aruba’s Public Prosecution Service (OM) has imposed several settlements of up to Afl. 15,000 in recent months in cases involving human smuggling and illegal employment.

The settlements were imposed on both companies and individuals. According to the OM, the suspected conduct included helping people enter Aruba illegally, providing accommodation to people staying on the island unlawfully, and employing people who were not legally allowed to work in Aruba.

These acts are punishable under Articles 2:154 and 2:155 of Aruba’s Penal Code. The OM says it prosecutes such offences because they undermine government efforts to combat illegal residence and illegal employment and can contribute to an underground circuit with broader negative consequences for society.

According to prosecutors, the harm is not limited to foreign nationals but can also affect the local community. The OM is therefore urging employers and landlords in particular to make sure they are properly informed about the law before helping someone come to Aruba, renting accommodation to them or employing them.

The OM warns that while some cases can be resolved through a meeting with a prosecutor and a settlement, others may still be brought before a judge.
