Public Prosecutor: C. Fernandez Pedra faces five criminal charges in fatal hit-and-run case

ORANJESTAD – Aruba's Public Prosecution Service outlined its case on Friday against C. Fernandez Pedra, the driver charged in connection with the fatal hit-and-run crash of January 4, 2026, in which two pedestrians died and two other people surviveAccording to the prosecutor, the defendant faces five criminal charges, all stemming from the events of that day.

The primary charges are two counts of homicide involving Vasquez Gonzalez and Vianes Valerio. The prosecution alleges that Fernandez Pedra was driving a Jeep Compass without a valid driver's license, while under the influence of alcohol, in an emotional state, and at a speed far exceeding what was safe and legally permitted.

The prosecutor argued that the vehicle was traveling at an irresponsibly high speed, preventing the driver from stopping within the visible distance of the roadway.

According to the prosecution, the defendant also failed to pay sufficient attention to other road users, particularly pedestrians crossing the road, failed to keep to the right side of the roadway, drove partially or entirely in the center of the road and failed to take evasive action to avoid the collision.

Based on the same alleged conduct, the prosecution has also filed alternative charges for violating Aruba's Traffic Ordinance and, alternatively, for creating a dangerous traffic situation.

The second charge concerns two counts of attempted homicide involving Ms. Willems and Mr. Hernandes Rivas. Alternatively, prosecutors argue the conduct amounts to two counts of attempted serious bodily injury.

The third charge is leaving the scene of the accident.

The fourth charge is driving under the influence of alcohol.

The fifth charge is driving without a valid driver's license.

The prosecution presented its arguments during Friday's hearing. The court will continue hearing the case before issuing its decision.
